Privacy Policy

Museli (operated by MUSELI PTY LTD, ABN 53 657 020 990) is committed to protecting your privacy. This policy outlines our ongoing obligations to you in respect of how we manage your Personal Information. We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The APPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information. A copy of the Australian Privacy Principles may be obtained from the website of the Office of the Australian Information Commissioner at www.oaic.gov.au. Where applicable, we also comply with the EU and UK General Data Protection Regulation (GDPR) for users in the European Economic Area and the United Kingdom, and the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA) for California residents.

We do not sell your personal information. Museli does not sell your Personal Information, and we do not share it for cross-context behavioural advertising. We do not use your information to serve you third-party advertising. We will not use or share your information with anyone except as described in this Privacy Policy.

If you choose to use our Service, then you agree to the collection and use of information in accordance with this policy. The Personal Information that we collect is used for providing and improving the Service. The terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, unless otherwise defined in this Privacy Policy.

Information We Collect

To provide and improve the Service, we may collect the following categories of information:

  • Account information you provide: first name, email address, username/handle, a password (where you register with an email address), and an optional profile picture. If you sign in with Google or Apple, we receive basic profile details from that provider instead of a password. You can also use the app as a guest without creating an account, in which case we collect only the limited information needed to provide the app on your device (such as a device identifier and your in-app activity); you can convert a guest session into a full account, or ask us to delete your guest data, at any time.
  • Music and practice data: information about your instrument, level or grade, lesson and practice progress, and your activity and usage statistics within the app, so we can track your progress and personalise your learning.
  • Recordings and materials you submit: audio and video recordings (for example, of your practice or lessons) and other materials you choose to upload (such as audio, video or PDF files). These are stored securely as described under "Storage, Security and Retention".
  • Purchase information: your membership and subscription status and purchase history, provided to us through the Apple App Store, Google Play and RevenueCat. We do not receive or store your full payment card details.
  • Device and technical information: a device identifier, device name, IP address, operating system and app version, time zone, and a push-notification token (Firebase Cloud Messaging) where you enable notifications.
  • Support and feedback: the contents of any support requests, feedback or other communications you send us.

Microphone Audio Is Processed On Your Device

Museli is a music app, so it listens to you play. When you use the tuner, pitch detection, practice and play-along features, audio from your microphone is analysed in real time entirely on your device. This live microphone audio is not recorded, transmitted to our servers, or shared with third parties. Audio only leaves your device if you deliberately record and save or upload a performance, in which case it is handled as a recording described above. The camera and photo library are accessed only when you choose to add a profile picture or to record or upload content, and not otherwise.

How We Use Your Information

We use the information we collect to:

  • provide, operate, maintain and personalise the Service, including tracking your progress;
  • process your memberships, subscriptions and purchases;
  • respond to your support requests and communicate with you about the Service;
  • send you service-related and, where you have enabled them, push notifications;
  • understand how the Service is used and improve it (see "Analytics" below);
  • maintain the security and integrity of the Service and prevent fraud and abuse; and
  • comply with our legal obligations.

For users in the EEA and UK, our legal bases for processing are: performance of our contract with you (to provide the Service); your consent (for example, push notifications and optional recordings); our legitimate interests (such as securing and improving the Service, including the pseudonymised analytics described below); and compliance with legal obligations.

Analytics

We use Amplitude to understand how the app is used and to improve it. We do not include the Amplitude SDK in the app, so Amplitude does not collect data directly from your device or set identifiers on it. Instead, our servers send Amplitude pseudonymised usage and event data, keyed to a pseudonymous identifier that is not directly linked to your name or email. Amplitude acts as our service provider and is contractually restricted from using this data for its own purposes. We do not use third-party advertising networks, and we do not use analytics to serve you ads or to sell or share your Personal Information. You can ask us to stop processing your information for analytics at any time by contacting compliance@museli.app. You can review Amplitude's privacy practices in its privacy policy.

Log Data

We want to inform you that whenever you use our Service, in the case of an error in the app, we may collect data and information (through the app and our service providers) called Log Data. This Log Data may include information such as your device Internet Protocol ("IP") address, device name, operating system version, the configuration of the app when utilising our Service, the time and date of your use of the Service, and other statistics. This information is used to diagnose problems and keep the Service secure and reliable.

Cookies

Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device's internal memory.

The Museli app does not use cookies. Our website may use a small number of cookies or similar technologies, and loads certain third-party resources (such as Google Fonts), which may collect limited technical information. You can set your browser to refuse cookies or to alert you when a cookie is being sent; if you refuse cookies, some portions of our website may not function correctly.

Third Parties and Service Providers

We engage trusted third-party companies to help us operate and provide the Service, for reasons including:

  • To facilitate and provide the Service on our behalf;
  • To perform Service-related functions (such as authentication, storage, billing and notifications); or
  • To help us understand how the Service is used.

These third parties have access to your Personal Information only to perform the tasks assigned to them on our behalf, and they are contractually obligated not to disclose or use it for any other purpose. The third-party services we use include:

  • Google / Firebase: authentication, push notifications (Firebase Cloud Messaging), and remote configuration and version gating (Firebase Remote Config).
  • Amazon Web Services (AWS): secure storage of recordings and uploaded materials.
  • Apple: Sign in with Apple and App Store billing.
  • Google Play: billing.
  • RevenueCat: subscription and purchase management.
  • Amplitude: product and usage analytics.
  • YouTube (Google): embedded video playback.

Data We Collect from Third Parties

  • If you choose to sign in with a third-party account (for example your Google or Apple account), we receive information from that provider, such as your name, email address and profile picture;
  • Data from the platforms the app runs on (for example, to verify payments);
  • If you make purchases in the Service, we retrieve data relating to the transactions from the involved third-party payment service providers (Apple, Google and RevenueCat) to validate those purchases.

YouTube API Integration

Our app uses the YouTube API to display video content within the app. In accordance with YouTube's API Services Developer Policies, we are required to disclose the following information in our privacy policy:

  • Google Privacy Policy: By using the YouTube API, our app integrates with services provided by Google LLC ("Google"). As a result, your use of the YouTube features within our app is subject to Google's Privacy Policy, which can be found at https://policies.google.com/privacy.
  • Data Collection and Usage: When you interact with the YouTube video player within our app, we may collect certain usage data, such as video watch progress and user preferences, to enhance your experience and provide personalized features. This data is used solely for the purpose of providing and improving the app's functionality and is not shared with third parties, except as required by law or with your explicit consent.
  • Data Retention: We store the collected usage data only for as long as necessary to provide the features and functionality of our app. Once the data is no longer required, we will securely delete or anonymize it to ensure your privacy is protected.
  • YouTube API Restrictions: Please note that the YouTube API features within our app are subject to the YouTube Terms of Service, the YouTube API Services Terms of Service and Google's API Services User Data Policy. By using the YouTube API features in our app, you agree to comply with these terms and policies.

International Data Transfers

Museli is based in Australia, and our service providers may store and process your information in Australia, the United States and other countries. Where we transfer Personal Information internationally, including from the EEA or UK, we take reasonable steps to ensure it is handled securely and in accordance with this policy and applicable law, including by relying on appropriate safeguards such as Standard Contractual Clauses where required.

Storage, Security and Retention

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure. Information transmitted to us is sent over encrypted connections, and uploaded recordings and materials are transferred using secure, time-limited links and stored with our cloud storage provider (AWS).

We keep your Personal Information while your account is active. When you delete your account, or when the information is no longer needed for the purpose for which it was collected, we will take reasonable steps to delete or permanently de-identify your Personal Information, generally within 90 days. We may retain certain information for longer where we are required to do so by law, for example financial and transaction records which must be kept for tax and accounting purposes for the period required by law.

Recordings have specific retention rules: on the free tier, recordings are automatically deleted after 30 days; on a paid membership, your recordings are retained until you delete them or close your account.

We value your trust in providing us your Personal Information, thus we are striving to use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or method of electronic storage, is 100% secure and reliable, and we cannot guarantee its absolute security.

Your Privacy Rights

You may access the Personal Information we hold about you and ask us to update or correct it, subject to certain exceptions. To make a request, please contact us at compliance@museli.app. We will not charge a fee for an access request. For EEA/UK and California residents we provide the first copy of your Personal Information free of charge, and may charge a reasonable fee, or decline to act, only where a request is manifestly unfounded, excessive or repetitive, as permitted by law. In other cases we may charge a reasonable administrative fee for providing additional copies. In order to protect your Personal Information, we may require identification from you before releasing the requested information.

EEA and UK residents (GDPR): MUSELI PTY LTD is the data controller responsible for your Personal Information. You have the right to access, rectify, erase, restrict and object to the processing of your Personal Information, the right to data portability, and the right to withdraw consent at any time where processing is based on consent. You also have the right to lodge a complaint with your local data protection supervisory authority.

California residents (CCPA/CPRA): you have the right to know about and access the Personal Information we collect, to request its deletion, to request correction, and to opt out of the "sale" or "sharing" of Personal Information. We do not sell or share Personal Information for cross-context behavioural advertising, and we have not done so in the preceding 12 months. We only use sensitive personal information, such as recordings and account credentials, to provide the Service you request and for purposes that do not trigger the right to limit its use, and we do not use or disclose it to infer characteristics about you; where applicable, you also have the right to limit our use of sensitive personal information. You also have the right not to be discriminated against for exercising your privacy rights.

To exercise any of these rights, contact us at compliance@museli.app, or use the account controls within the app. We may need to verify your identity before acting on a request. We will respond to verifiable requests within the timeframes required by law, generally within one month for EEA/UK requests and within 45 days for California requests, with extensions where permitted.

Deleting Your Account and Data

You can delete your account and associated Personal Information at any time from within the app's account settings, or by emailing us at compliance@museli.app. When you delete your account we will delete or de-identify your Personal Information as described under "Storage, Security and Retention", subject to any information we are required to retain by law.

Children's Privacy

These Services are not directed to children under the age of 13, and we do not knowingly collect personally identifiable information from children under 13 years of age. In the case we discover that a child under 13 has provided us with personal information, we take steps to delete it from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we can take the necessary action.

This Service may contain links to other sites. If you click on a third-party link, you will be directed to that site. Note that these external sites are not operated by us. Therefore, we strongly advise you to review the Privacy Policy of these websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

Maintaining the Quality of Your Personal Information

It is important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

Policy Updates

This Policy may change from time to time and the current version is always available on our website. Where changes are material, we will take reasonable steps to notify you. The date of the most recent update is shown at the bottom of this page.
